Chief Justice Pascal F. Calogero, Jr. announced today the Supreme Court’s adoption of amendments to the Rules of Professional Conduct concerning financial assistance to clients.1 The new rule changes place a number of parameters and restraints on lawyers who provide financial assistance to their clients, and thereby promote clarity, consistency and accountability. Chief among the beneficial changes to the rules is the placement of a monetary cap on the amount of interest charges that lawyers may pass on to their clients when lawyers are involved in procuring financial assistance for their clients.

Rule 1.8(e)(5)(ii), first sentence, Louisiana Rules of Professional Conduct, be and is hereby amended to read:
(ii) Financial assistance provided by a lawyer to a client may be made using a lawyer’s line of credit or loans obtained from financial institutions in which the lawyer has no ownership, control and/or security interest; provided, however, that this prohibition shall not apply to any federally insured bank, savings and loan association, savings bank, or credit union where the lawyer’s ownership, control and/or security interest is less than 15%.

Any attorney who was admitted to the practice of law in Louisiana in calendar year 2004 shall be allowed until the end of calendar year 2006 to fulfill the CLE requirements contained in La. S. Ct. Rule XXX, Rule 3(b). No other CLE requirements shall be imposed upon 2004 admittees in calendar year 2006.

The Louisiana Supreme Court shall be closed through November 25, 2005. Such closure shall serve as an exception to Part One, Chapter 6, Article 11, Section 2 of the Human Resource Management Manual for the Louisiana Supreme Court. For purposes of computing the timeliness of filings, the period of the Court’s closure from August 29,2005 through November 25,2005 will be considered a legal holiday, and thus pleadings otherwise due in this Court during this legal holiday will be due on Monday, November 28,2005.

The Louisiana Supreme Court has approved a temporary rule allowing non-admitted lawyers to provide pro bono civil legal assistance in Louisiana. The rule, in force through Feb. 28, 2006, limits lawyers to handling civil issues arising out of Hurricanes Katrina and Rita. The rule also lists specific application procedures

The Louisiana Supreme Court issued an order Oct. 3 allowing judges in Louisiana trial and appellate courts to lift or shorten the legal deadlines suspension outlined in Gov. Kathleen Blanco’s executive orders KBB 2005-32 and KBB 2005-48. The order outlines specific procedures for judges, as well as offers a means for private parties to request shortening or lifting the suspension
