Rules of Professional Conduct Committee

The mission of the Committee on the Rules of Professional Conduct shall be to promote professional ethics in the practice of law within the State of Louisiana and shall include the following specific tasks:

(1)To monitor and evaluate developments in legal ethics and, when appropriate, recommend changes to the Louisiana Rules of Professional Conduct;
(2)To act as a liaison to the Louisiana Supreme Court on matters concerning the Rules of Professional Conduct;
(3)To respond to inquiries from the Louisiana Supreme Court on matters of legal ethics, as may be received from time to time;
(4)To review issues of legal ethics arising from the practice of law within this State, including proposals to add, delete, or modify existing ethical rules, and make recommendations regarding such changes to the LSBA House of Delegate;
(5)To oversee the work of the Ethics Advisory Service Advertising Committee, Publications Subcommittee and such other subcommittees as may be formed from time to time;
(6)To promote the highest professional standards of ethics in the practice of law within this State, and to support and encourage all members of the bar in their efforts to achieve those standards.

LSBA Rules Committee Votes Not to Proceed Further with Subcommittee Recommendations re: ABA Model Rule 8.4(g)

At its meeting on Oct. 30, 2017, the LSBA Rules of Professional Conduct Committee debated a proposed amendment to Rule 8.4 of the Louisiana Rules of Professional Conduct as proposed by a subcommittee charged with studying recently-enacted ABA Model Rule 8.4(g).

The primary arguments made by those opposing the amendment were that: 1) existing rules permit the Office of Disciplinary Counsel to investigate and seek sanctions for much of the conduct that would be covered by the proposed Rule, thus making it unnecessary; and 2) the proposed Rule may contain terms of sufficient ambiguity such that it could engender litigation, and/or present uncertainty to lawyers in the state attempting to comply with the Rule.

At the conclusion of the discussion, the Rules Committee voted 7-4 not to recommend the proposed amendment to Louisiana Rule 8.4 to either the LSBA House of Delegates or to the Louisiana Supreme Court.

Under Rule 7.7, lawyers are obligated to file ALL non-exempt advertisements and unsolicited written communications with the LSBA Rules of Professional Conduct Committee, through LSBA Ethics Counsel, prior to or concurrent with first use/dissemination of the advertisement/communication.
