Fit to Practice


The second in this three-part series, titled "Fit to Practice," focuses on liability and ethics issues in the event an attorney experiences a short or long-term disability. This session is especially relevant to solo and small firm attorneys.

Substance abuse, physical and mental health disability issues affect people of all professions - and lawyers are no exception. In addition to the personal challenges of those suffering from these issues, this brings potential risk to the attorneys as they handle important matters and continue to work in the profession. This session will discuss the risks and ethics/liability issues that attorneys with disabilities face. In addition, it will offer resources available in Louisiana to help practitioners, and give practical advice on avoiding personal and vicarious liability during this process.


The LSBA is pleased to offer a unique opportunity to view this CLE seminar at a Baton Rouge satellite location, while receiving full CLE credit.  Please note on the registration page which site you will be attending.

Cancellation Policy: All cancellations must be received in writing and sent to diversity@lsba.org; telephone cancellations will not be accepted. Cancellations received in writing before January 14, 2016, will be fully refunded minus a $10.00 administrative fee. If written confirmation of cancellation is not received by January 14, 2016, no refunds or credits will be issued of any kind. Credits will be processed within two weeks of receipt of the cancellation request.

SPEAKERS

Bryan Jenkins has more than 28 years experience in the insurance industry. As a group benefits consultant for Gilsbar, Mr. Jenkins manages benefit plans for large groups in the Louisiana State Bar Association and the Society of Louisiana Certified Public Accountants. Mr. Jenkins is certified in consumer directed healthcare by the National Association of Health Underwriters, was a fellow for the Life Underwriting Training Council and has presented to numerous organizations on healthcare, benefits and consumer driven health plans. Mr. Jenkins received his Bachelor’s degree from Louisiana State University.

Richard P. Lemmler, Jr. has been Ethics Counsel for the Louisiana State Bar Association since May 2002. Until mid-September 2011, he and his staff were responsible for the day-to-day operations and administration of the LSBA’s Ethics Advisory Service, providing confidential, informal advice and ethics advisory opinions as needed to the nearly 21,500 lawyer members of the Association, including advice and opinions on proposed lawyer advertising. While still regularly involved with offering advice and opinions through the Ethics Advisory Service, Mr. Lemmler now focuses the majority of his time on the operation and administration of the LSBA’s lawyer advertising filing and evaluation program, while continuing to work very closely with the LSBA Rules of Professional Conduct Committee. Prior to June 2008, he also offered staff support for several consecutive years to the LSBA Legislation Committee, as well as to a variety of subcommittees for other LSBA standing committees. Mr. Lemmler is frequently called upon to speak about legal ethics, including lawyer advertising and he has written a number of articles for the Louisiana Bar Journal. He was presented the LSBA President’s Award in June 2007 for his service to the LSBA Rules of Professional Conduct Committee on the Bar’s lawyer advertising initiative. Before joining the LSBA staff, Mr. Lemmler practiced law in New Orleans for 14 years as a solo general practitioner. He also served two consecutive three-year appointments to the Louisiana Attorney Disciplinary Board, first as a lawyer member of a disciplinary hearing committee and then as chair of a hearing committee.

Julie Brown White is a partner in the law firm of Schiff, Scheckman, & White LLP. The members of the firm practice law in the areas of legal and judicial ethics as well as other lawyer related issues. Ms. White’s office is located in Baton Rouge. She represents lawyers in all stages of disciplinary proceedings and applicants in bar admissions matters. She practiced in Baton Rouge in the area of civil litigation for several years, primarily as an associate for the firm of deGravelles, Palmintier & Holthaus, before joining the Office of Disciplinary Counsel in 1998. Ms. White was a prosecutor for the Office of Disciplinary Counsel from 1998-2006. In 2006, she opened her solo practice in Baton Rouge primarily in the areas of legal ethics and lawyer discipline. Ms. White is a member of the Association of Professional Responsibility Lawyers, the Baton Rouge Bar Association and the Baton Rouge Association of Women Attorneys. She is a former member of the National Organization of Bar Counsel and the Louisiana Trial Lawyers Association. She is a frequent speaker to lawyers groups around the state on ethics, disciplinary and professional responsibility issues. She has served as a member of the Louisiana State Bar Association’s Practice Assistance and Improvement Committee since 2007 and has served as chairman of the committee since 2010. She served on the initial certifying board for the Louisiana State Paralegal Association and assisted in writing the ethics portion of the first certifying exam for this association. She earned a B.A. in history from LSU in 1987 and a law degree from Ole Miss in 1990.

J. E. “Buddy” Stockwell, III is the Executive Director of Louisiana’s Judges and Lawyers Assistance Program, Inc. (JLAP) He earned a BS in Organizational Management from LSU in 1989 and JD from LSU in 1993. Prior to beginning his career at LAP he was a solo practitioner in Baton Rouge, Louisiana, focusing primarily on domestic litigation. He is a long-standing member of the Louisiana State Bar Association’s Committee on Alcohol and Drug Abuse, a Certified Suicide Prevention Gatekeeper, and Certified Clinical Alcohol and Addiction Interventionist.
